Can an attacking player in an offside postion be penalized when recieving the ball from a free kick?

Yes. Unless the ball came to him directly from an opponent's free kick.

Yes. Not on a corner kick, goal kick, or throw in.

Of course if it is a free kick from his teammate and is not a goal or corner kick.
